These Terms and Conditions govern the provision of services by Quest End Ltd ("we", "us", "our", "the Company"), a company registered in England and Wales. By accepting a quotation or engaging us to carry out work, you ("the Client") agree to be bound by these terms.
Quest End Ltd is a specialist custom installation company providing home cinema, smart home automation, lighting control, commercial AV, and structured networking services to residential and commercial clients throughout the United Kingdom.
In these Terms and Conditions, the following definitions apply:
All Quotations issued by Quest End Ltd are valid for 30 days from the date of issue unless otherwise stated in writing. After this period, prices may be subject to change due to supplier price movements, currency fluctuations, or changes in specification.
Quotations are based on the information provided to us at the time of survey or consultation. If, during installation, it becomes apparent that additional work is required that was not foreseeable at the time of quotation (such as concealed wiring difficulties, structural obstacles, or building defects), we will notify you and provide a revised figure before proceeding.
Quotations are prepared without obligation and do not constitute an offer capable of acceptance by you unless and until we confirm acceptance in writing.
An Agreement is formed when the Client provides written acceptance of a Quotation (including acceptance by email) and Quest End Ltd confirms the booking in writing. In some cases, receipt of a deposit payment will constitute acceptance of the Quotation and these Terms.
Quest End Ltd reserves the right to decline any order at our discretion, including where supply chain issues, scheduling constraints, or other factors make fulfilment impractical.
Any special or custom-ordered equipment ordered following your acceptance is non-cancellable and non-returnable unless the item is found to be defective upon delivery.
Unless otherwise specified in the Quotation, our standard payment schedule is as follows:
All invoices are payable by bank transfer within 7 days of the invoice date unless otherwise agreed in writing. Overdue balances may attract interest at 8% above the Bank of England base rate per annum under the Late Payment of Commercial Debts (Interest) Act 1998.
Ownership of all Goods remains with Quest End Ltd until payment has been received in full. We reserve the right to recover Goods from site in the event of non-payment.
All prices quoted are exclusive of VAT unless otherwise stated. VAT will be charged at the applicable rate on all invoices.
Cancellations must be made in writing. The following cancellation charges apply:
Any variation to the agreed scope of works must be agreed in writing. We reserve the right to charge for additional work or materials required as a result of variations requested by the Client. Variations may also affect the project timeline.
The Client is responsible for providing safe, unobstructed access to the Site at the agreed times. Where access is delayed or denied, Quest End Ltd may charge for lost time at our prevailing day rate.
The Client is responsible for ensuring that all areas in which work is to be carried out are clear of furnishings, valuables, and obstructions prior to commencement. Quest End Ltd will take reasonable care of the Site but cannot be held responsible for pre-existing damage or for minor cosmetic disturbance incidental to the installation works (such as minor dust or cable routing marks that would normally be made good during redecoration).
Where the work involves routing cables through walls, ceilings, or floors, the Client should be aware that some redecoration may be required following completion. Quest End Ltd will use concealed or minimally invasive routing methods where practicable.
Quest End Ltd engineers comply with all relevant health and safety legislation. Clients are requested to notify us of any site-specific hazards, asbestos surveys, or restrictions prior to work commencing.
All Goods supplied by Quest End Ltd are sourced from reputable, authorised distributors. We are approved dealers for brands including Savant, Crestron, Lutron, Rako, and KNX, among others.
Quest End Ltd reserves the right to substitute specified products with equivalent alternatives of equal or greater specification in the event of supply chain issues, without reduction in price, provided the Client is notified in advance.
The risk in Goods passes to the Client upon delivery to the Site. Ownership passes to the Client once full payment has been received.
The Client must inspect all delivered Goods promptly and notify Quest End Ltd in writing of any visible damage or shortage within 48 hours of delivery.
Quest End Ltd provides a 12-month workmanship warranty on all installation and programming work carried out by our engineers, commencing from the date of practical completion.
All Goods supplied are covered by the manufacturer's warranty, which varies by product and brand. Quest End Ltd will assist Clients in making warranty claims with manufacturers where applicable.
The workmanship warranty does not cover:
Warranty call-outs are provided free of charge during the warranty period where the defect is attributable to our workmanship. Call-outs arising from user error, third-party interference, or equipment failure outside the workmanship warranty may be charged at our prevailing day rate.
Quest End Ltd carries full public liability insurance and employer's liability insurance. Certificates are available on request.
Our total liability to the Client under or in connection with any Agreement, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall not exceed the total value of the contract to which the claim relates.
Quest End Ltd shall not be liable for:
Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited or excluded by law.
All system designs, drawings, programming code, and configuration files created by Quest End Ltd in connection with a project remain the intellectual property of Quest End Ltd unless otherwise agreed in writing.
The Client is granted a non-exclusive licence to use such materials for the purpose of operating and maintaining the installed system at the Site. Designs and configurations may not be reproduced, shared with third parties, or used for other projects without our prior written consent.
Quest End Ltd processes personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. For full details of how we collect, store, and use personal information, please refer to our Privacy Policy.
These Terms and Conditions and any Agreement formed under them are governed by and construed in accordance with the laws of England and Wales. Any dispute arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
